Do You Have to Look for Work While Receiving Unemployment Benefits?

There are many misconceptions surrounding unemployment benefits. This is no surprise because, as with most government programs, the requirements and rules surrounding unemployment benefits can be extremely confusing. This confusion often causes people receiving these benefits to feel anxiety. They worry that they will make a mistake and lose their benefits. One of the most misunderstood elements of unemployment is whether or not you are required to look for work. The specifics vary from state to state, so we will use Massachusetts as an example while explaining this aspect of unemployment benefits. With a 4.4% unemployment rate, the Bay State has its fair share of unemployed people seeking benefits.

Understanding the Work Search Requirement in Massachusetts

Massachusetts, like most states, does have a work search requirement. Meaning that beneficiaries of unemployment benefits must be actively looking for work. You must be:

  • Able to work
  • Available to work
  • Actively looking for work

When filing your weekly unemployment claim, you must report your work search activities. Massachusetts currently requires at least three work search activities per week for most claimants.

What Counts as a Work Search Activity?

Now, you’re probably wondering what exactly a work search activity is. Well, it’s defined by the Department of Unemployment Assistance. Generally, a work search activity is one of the following:

  • Submitting job applications
  • Sending resumes or letters of interest
  • Attending job interviews
  • Meeting with potential employers
  • Participating in job fairs
  • Attending employment workshops or networking events
  • Registering with employment or placement agencies
  • Using employment resources such as MassHire JobQuest

Basically, a work search activity is any activity which shows that you are seriously and actively trying to find new employment opportunities.

Why Keeping Records of Your Job Search Is Important 

As mentioned, you must report your work search activities. This means you need to keep records of your job search. Details you should keep track of for each activity include: 

  • The date of the activity
  • The employer or organization
  • The type of work search activity
  • Relevant contact information or other details

Remember, this is extremely important. Incomplete documentation could make it more difficult to verify that you met the work search requirement, which could make things extremely difficult for you.

What Happens If You Don’t Look for Work? 

Massachusetts unemployment benefits are week to week. You are basically applying every week. If you do not look for work, meaning you did not complete the required three job search activities, you likely will not receive your unemployment benefits for that week. Continue to not look for work, and you will continue to not receive any benefits.

Do You Have to Accept Any Job You’re Offered?

Massachusetts law does not require you to accept any job you are offered. Instead, you are only required to accept suitable work. Suitable work means:

  • Training and Experience: The job must match your prior skill level and background, especially during the first few weeks of unemployment.
  • Health and Safety: The work cannot be harmful or dangerous to your physical health, safety, or morals.
  • Distance: The workplace must be a reasonable commute from your home or your previous job.
  • Labor Disputes: A job opening is not suitable if the position is vacant because of a strike, lockout, or active labor dispute.

Refusing a job that meets these requirements will likely result in the loss of your unemployment benefits. 

Are There Exceptions to the Work Search Requirement?

Exceptions for the work search requirement are very rare. The most common exception is if you enroll in the Training Opportunities Program (TOP), which may allow eligible participants to continue receiving benefits without the normal job-search requirement. TOP is a state initiative that allows you to collect unemployment insurance (UI) benefits while enrolled in a full-time, approved job skills training program. It can be a great way to find gainful employment again.

What If Your Unemployment Benefits Are Questioned or Denied?

 

It is very common for benefits to be questioned or denied. Issues can arise due to: 

  • Whether you’re actively searching for work
  • Whether you’re job search activities were properly reported
  • Whether you’re available for suitable work
  • Whether an exception applied
  • Whether you refused suitable work

If this happens, it is best to contact a Massachusetts Unemployment Lawyer. They will be able to help you fight the denial of your benefits and get what you are entitled to.
